Terms of Use

The short version
Use Pyramid to write whatever you like. Your notes are yours and we claim nothing over them. The app itself is ours and is licensed to you, not sold. It comes without guarantees, which matters because your notes are files you are responsible for backing up.
Agreement
These terms are between you and Electric Pass Labs, LLC d/b/a Pyramid, and they cover the Pyramid apps for Mac and iPhone and the pyramidkit.com website. By installing or using Pyramid you accept them. If you do not, please do not use the app.
Your licence to use Pyramid
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Pyramid on devices you own or control, for as long as you comply with these terms.
Pyramid is closed-source software. Except where local law says otherwise, or where a separate written agreement with us says otherwise, you may not:
- copy, sell, rent, sublicense or redistribute the app
- reverse engineer, decompile or disassemble it
- remove or obscure any copyright or ownership notices
- use it to build a competing product
We keep all rights in the app, its name, its design and its logo. Nothing here transfers any of them to you.
Your notes are yours
You own everything you write in Pyramid. We claim no licence over it, no right to use it and no right to read it. Because your notes stay on your own device and in your own iCloud, this is a matter of architecture as much as promise: we have no copy to claim rights over.
You are responsible for what you write and for having the right to store it.
Backups
Pyramid stores your notes as plain files on your device. Keeping those files backed up is your responsibility. We strongly recommend a backup routine you trust, such as Time Machine or another tool, and we are not able to recover notes for you, since we never hold them.
Acceptable use
Do not use Pyramid to break the law, to infringe anyone's rights, or to interfere with the app's operation or its update service. Do not attempt to gain unauthorised access to any system of ours.
Third-party services
Sync runs on Apple's iCloud and mobile distribution runs through the App Store. Those are Apple's services, governed by Apple's terms, and their availability and behaviour are outside our control. Where you obtained Pyramid through the App Store, Apple's own end user licence terms also apply, and prevail over these terms to the extent they conflict.
Updates and changes to the app
We may release updates that add, change or remove features. The Mac app can install updates automatically. We may also discontinue Pyramid or any part of it. Because the app works offline and your notes are plain files in a folder you control, you keep full access to everything you have written even if the app stops being updated.
Price and payment
Pyramid is currently free to download and use. We may charge for future versions or releases, and any paid terms, refunds and renewals will be as stated at the point of purchase or, for App Store purchases, as handled by Apple.
No warranty
Pyramid is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error free, or that it will preserve or sync any particular file. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost notes or lost data arising from your use of Pyramid. Our total liability relating to Pyramid is limited to the amount you paid for it in the previous 12 months. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Ending this agreement
You may stop using Pyramid at any time by deleting the app; your notes remain in your folder. We may suspend or end your licence if you materially breach these terms. The sections on ownership, warranties, liability and governing law survive the end of this agreement.
Changes to these terms
We may revise these terms. When we do, we will update the date at the top of this page, and where a change is significant we will note it in the release notes. Continuing to use Pyramid after a change means you accept the revised terms.
Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law rules, and the state and federal courts located in Colorado have exclusive jurisdiction over any dispute, except that if you are a consumer you may also have the right to bring proceedings in your own country of residence.
